DISCRIMINATION COMPLAINT PROCEDURE
In order to provide for an orderly and equitable process for handling discrimination complaints from District employees, students, or applicants for District positions, the following discrimination complaint procedures will be utilized.
If an employee, student, or an applicant for a position with the District feels that he/she has been illegally discriminated against, that person shall be advised to talk with the EEO/AA facilitator representing the appropriate area of the District. The person shall be advised of his/her right to pursue a complaint of discrimination internally through the process provided by this EEO/AA Program. The EEO/AA facilitator will be expected to discuss the problem with the complainant and with other involved parties in an attempt to facilitate communication and resolve the matter in an informal manner. If the complainant is not satisfied with the results of the informal process, he/she may proceed to the formal complaint procedure.
When the informal complaint procedure does not result in settlement of a complaint of illegal discrimination, the complainant may formalize his/her complaint in writing and submit it to a hearing committee. The complaint should be filed within thirty calendar days of the alleged discriminatory act. It should include the date of the occurrence of the matter, location, person or persons involved, witnesses, the facts and/or rationale of the complaint, and the relief sought.
Upon receipt of the complaint, the hearing committee shall investigate the complaint of discrimination and conduct a private hearing if it feels such a hearing is appropriate. After the hearing committee has determined the facts and decided what if any corrective action is necessary, it shall report its determination in writing to the complainant and any other parties involved. This report shall be issued within thirty calendar days of receipt of the written complaint. If the complainant is not satisfied with the decision of the hearing committee, he/she will have ten days to appeal in writing to the Chancellor. The Chancellor will review the complaint and report final disposition of the complaint within ten days.
POLICY AND PROCEDURE ON SEXUAL HARASSMENT
Eastern Iowa Community College District believes that all students have the right to be free from sexual harassment by colleagues, supervisors, instructors, and other district employees. EICCD will not tolerate or condone actions and/or words which a reasonable person would regard as sexually harassing or coercive.
Specifically, no EICCD supervisor, instructor, or other district employee shall threaten or insinuate, either explicitly or implicitly, that a student's refusal to submit to sexual advances will adversely affect the student's course performance evaluation and/or advancement at any EICCD college.
Other sexually harassing conduct, whether committed by EICCD employees or students, is also prohibited. This includes repeated offensive sexual flirtations, advances, or propositions; continuous or repeated verbal abuse of a sexual nature; graphic verbal commentaries about an individual's body; sexually degrading words used to describe an individual; the display of sexually suggestive objects or pictures; and acts of physical contact such as patting, pinching or constant brushing against another's body.
Students subjected to acts of sexual harassment should advise the Dean of Student Development or the EEO/AA Officer. The investigation of a sexual harassment complaint will be conducted according to the following guidelines:
A.) A support person (i.e., counselor or advisor) may be present during any stage of the complaint process.
B.) A person bringing a complaint in good faith will not suffer any retaliation.
C.) An investigation will be conducted as soon as possible and the results reported to the complainant.
D.) Efforts will be made to keep the investigation confidential for both the complainant and the accused.
E.) If the complaint is found to be valid, the person who has committed the act/acts of sexual harassment will receive appropriate counseling and/or be subject to disciplinary action.
SEXUAL ASSAULT PREVENTION PROGRAMMING AND
REPORTING PROCEDURE SEXUAL ABUSE (ASSAULT)
The Higher Education Amendments of 1998 require the EICCD to disclose a statement of policy concerning its sexual assault programs designed to prevent sex offenses, and procedures to follow once a sex offense occurs. Sexual abuse in its various forms as it is defined in the Iowa Criminal Code, Chapter 709, is a serious crime, which shall not be condoned on college premises. Most simply, sexual abuse occurs when one person forces another person to engage in a sexual act against his or her will. Acquaintance or date rape is a specific example of sexual abuse. Force applied by an offender in committing sexual abuse could include physical violence or the threat of physical violence, psychological coercion or intimidation.
EDUCATION PROGRAMS
Programs to promote the awareness of rape, acquaintance rape, and other forcible and non-forcible sex offenses are sponsored at various times of the year on campus. Check the campus calendar or the Dean of Student Development's office for details.
REPORTING PROCEDURES
As with any serious crime committed or attempted on college premises, it is the practice of EICCD to encourage the victim to report any allegation of sexual abuse, including acquaintance rape, to the proper authorities for investigation. EICCD will assist in the reporting process upon request. Section D19 of the administrative procedures manual describes the process and form used for reports. This incident/accident form is used for reporting all injury, damage, loss, accidents, crimes, incidents, etc. If a sex offense occurs, it is important that any evidence be preserved as it may be necessary to prove a criminal offense.
As with other incident reporting, contact should be made with the Dean of Student Development or Ancillary Services Office. The local police department has law enforcement authority for campus crimes. After reporting occurrences to the site Administrator, any criminal occurrences should also be reported to the local police. Students have the option to contact proper law enforcement authorities, and the college will assist if requested.
In cases of either sexual abuse or sexual harassment, the College shall consider appropriate disciplinary actions against individuals accused of these offenses conditioned on the facts determined in each case. The procedures are outlined in the EICCD Student Code of Conduct, and Student Discipline and Due Process Code. The process allows for both the accuser and accused to have the right to appear alone, with an advisor, or with legal counsel. Both parties will be informed of the outcome. Sanctions that may be imposed following the final determination are listed in chapter 5-501 disciplinary penalties of the EICCD Student Discipline and Due Process Code.

ACCOMMODATION
Upon request, the EICCD will change a victim's academic situation, and may assist with a victim's living situation after an alleged sex offense occurs. The victim will request these changes through the Dean of Student Development or the Ancillary Services Office, and an effort will be made to accommodate the request if changes are reasonably available.
ALCOHOL NOTICE
Violations of the College guidelines for the use of alcoholic beverages at events and of the District policies regarding alcoholic beverages on campus will result in disciplinary action by the Dean of Student Development. For more information regarding the District Alcohol Policy, please consult Board Policy 836.
The Student Senates at Clinton, Muscatine and Scott Community Colleges have declared that no student activity fees nor student generated revenue shall be used for the purchase of alcoholic beverages.
ALCOHOL AND DRUG ABUSE PREVENTION
It is our intent and obligation to provide a drug-free, healthful, safe, and secure campus environment in order to promote an optimum learning environment.
The college recognizes drug abuse as a potential health, safety, and security problem. Students needing help in dealing with such problems are encouraged to seek help and utilize the resources made available through the campus and the community.
The unlawful manufacture, distribution, dispensation, possession, or use of a controlled substance on college premises or while representing the college off campus is absolutely prohibited. Violations of this policy will result in disciplinary action, up to and including expulsion, and may have legal consequences.
Alcoholic beverages may be allowed at certain college events with prior administrative approval. The guidelines for the utilization of alcoholic beverages at student events are available from the designated college activities coordinator. Violations of the District policies regarding alcoholic beverages will result in disciplinary action.

At Clinton, Muscatine and Scott Community Colleges, we are committed to promoting an awareness that drug and alcohol abuse is a health issue of significant concern to our institution, students and community. We are interested in providing information to the staff and students to promote prevention of substance abuse. We are concerned about providing support mechanisms to address the immediate problem of individuals who are abusing substances and to obtain the professional intervention needed to assist them.
